Partner Visa (820/801, 309/100)
One of the most common visas Au Migration Group assist with is Partner visas. Every relationship is unique and so a different approach is needed for each application. A Partner visa allows the partner/spouse or de facto partner of an Australian citizen, Australian permanent or Eligible New Zealand Citizen to live permanently in Australia.
A partner visa has two stages a temporary and then a permanent stage. For an onshore application the two stages are 820/801 and for offshore applications it is 309/100. Offshore means that the applicant is outside Australia at the time of application but the process for onshore and offshore visas are more or less the same.
For a successful application you must prove that as a couple you have a mutual commitment to a shared life as husband and wife to the exclusion of all others and the relationship is genuine and continuing and you live together, or do not live separately and apart on a permanent basis as well as meet health and character requirements. What is a de facto relationship?
You and your partner are in a de facto partner relationship if all of the following applies: You are not legally married to each other. Are committed to a shared life to the exclusion of all others. The relationship is genuine and continuing. You live together or do not live separately and apart on a permanent basis and are not related by family. Usually, your de facto relationship must have existed for at least 12 months immediately before you apply for the visa.
WHAT IS THE 12 Month rule for de-facto Relationships?
However, you would be exempt from the 12 month requirement if you register your relationship in an Australian state or territory. You would need to show that you are living together but not necessarily for 12 months.
Do I need Witnesses for a partner visa?
You will need your witnesses to provide a letter of support, statutory declaration, or Form 888 for your Partner Visa application. Depending on the background of your relationship, it may be recommended you provide anywhere from 2 to 6 witness statements.
